Is that not a scenario, where Emmer could gain ground faster? Since the Dayton totals would be far more likely to go down. I'd question its constitutionality under the MN constitution let alone the US. It's a remedy that causes more problems and injury than it "cures", and does nothing to add confidence in the electoral system.<br /><br />The numbers are pretty much insurmountable for Emmer, unless a major & catastrophic error is found during the recount. It's just not going to happen; the scope of the mistake is just too large to realistically occur in our system. As seen during the Franken recount, most of the mistakes and problems are relative small in scale, and the majority come in with rejected absentee ballots (which should have significantly less issues with the new procedures). So even if every error is found and every vote change goes in Emmer's favor...he's still gonna come up thousands of votes short.<br /><br />We should be done with this in December.
